1. Agreement
These terms govern your use of framemode.com (the "Site"), operated by Framemode LLC ("Framemode", "we", "us"), a United States limited liability company. By using the Site you agree to these terms. If you do not agree, do not use the Site.
2. The Site
The Site provides information about Framemode and its products and a way to contact us. We may change, suspend, or discontinue any part of the Site at any time without notice. Content on the Site is provided for general information and does not constitute professional advice or a binding offer.
3. Acceptable use
You agree not to: (a) probe, scan, attack, overload, or otherwise interfere with the Site or its infrastructure; (b) use the contact form to send unlawful, deceptive, or abusive content, or bulk unsolicited messages; (c) attempt to bypass security or rate-limiting measures; (d) scrape or harvest data from the Site at a scale or in a manner that burdens it; or (e) use the Site in violation of any applicable law, including export control and sanctions laws.
4. Intellectual property
The Site and its content, including text, design, graphics, logos, the Framemode mark, and the underlying code, are owned by Framemode or its licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to access and view the Site for your own informational use. No other rights are granted; do not reproduce the Framemode brand or content without written permission, except as permitted by law (for example, fair use).
5. Third-party sites and products
The Site may link to separate applications and third-party sites. Those are governed by their own terms and privacy notices, and we are not responsible for third-party content or services.
6. Contact submissions
When you contact us you confirm the information you provide is accurate and that you are entitled to share it. You grant us the right to use your submission to respond to you and evaluate a potential engagement. Do not send confidential or proprietary information through the contact form; nothing you send creates a confidentiality obligation, an engagement, or a professional relationship until a separate written agreement is signed.
7. Products and engagements
Framemode products and consulting engagements are provided under their own separate written agreements (including order forms, statements of work, and product terms). Those agreements, not these Site terms, govern any purchase or use of our products and services.
8. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED AVAILABILITY. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRAMEMODE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (USD $100). Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including, where applicable, liability for fraud or for death or personal injury caused by negligence, and nothing affects statutory rights that consumers are entitled to under mandatory local law.
10. Indemnity
You will indemnify and hold Framemode harmless from claims, damages, and reasonable costs (including attorneys’ fees) arising from your misuse of the Site or violation of these terms, to the extent permitted by applicable law.
11. Governing law and disputes
These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Texas, whose jurisdiction you accept. If you are a consumer in a jurisdiction whose law grants you mandatory protections or a right to sue in your home courts, nothing in this section takes those away.
12. General
If any provision of these terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These terms are the entire agreement between you and Framemode about the Site. We may update these terms by posting a revised version with a new date; continued use after a change means the updated terms apply. Questions: think@framemode.com.
